Terms of Service

1. Acceptance of these terms

By creating a Consistry account or using the Service, you agree to these Terms of Service. If you don't agree, please don't use the Service.

2. Eligibility

You must be at least 18 years old to use Consistry. By creating an account, you confirm that you meet this age requirement and that you have the legal capacity to enter into a contract.

3. The Service

Consistry is a trading journal and AI-powered analytics tool. It helps you log trades, track patterns in your behavior, and receive AI-generated insights based on the data you provide. The accuracy and usefulness of insights depends entirely on the quality and quantity of data you log.

4. Not financial advice

Consistry does not provide financial, investment, tax, or legal advice. The AI analysis, suggestions, and any output from the Service are for informational and self-reflection purposes only. We are not licensed financial advisors, brokers, or fiduciaries. Any decisions you make based on insights from Consistry are your own.

Trading financial instruments (forex, stocks, futures, crypto, etc.) carries a high level of risk and may result in the loss of all of your invested capital. Past performance is not indicative of future results.

5. Your account

You're responsible for keeping your account credentials secure. Don't share your password. Notify us immediately at support@consistry.com if you suspect unauthorized access.

6. Acceptable use

You agree not to:

• Reverse-engineer, scrape, or attempt to extract data from the Service.
• Use the Service to log fraudulent or fabricated trading data with the intent to abuse or test limits.
• Use Consistry to provide financial advice to other people or operate as a financial service yourself.
• Resell, sublicense, or redistribute the Service or its outputs.
• Bypass security features, rate limits, or paywalls.
• Upload malicious code, attempt to disrupt the Service, or harm other users.

We may suspend or terminate accounts that violate these rules.

7. Free and Pro plans

The Free plan is available without payment and gives you access to the journal and core features. The Pro plan is a paid subscription that unlocks AI features and additional capabilities. Pro pricing and features are described on the Pricing page and may change with reasonable notice.

8. Free trial

We may offer a free trial of the Pro plan. The trial requires a valid payment method. You can cancel anytime during the trial without being charged. If you don't cancel before the trial ends, your subscription will automatically begin and you'll be charged the applicable Pro fee.

9. Billing and cancellation

Pro subscriptions are billed in advance, monthly or annually, through Stripe. Subscriptions auto-renew unless you cancel. You can cancel anytime from your account settings. Cancellation takes effect at the end of your current billing period — no pro-rated refunds are issued for partial periods.

If you believe you were charged in error, email support@consistry.com and we'll review your case.

10. Refunds

We don't offer routine refunds — the free trial exists so you can decide before paying. However, if something is broken on our end, you're double-charged, or you have a legitimate complaint, contact support and we'll work with you in good faith to make it right.

11. Your data

You own the trading data you upload to Consistry. By using the Service, you grant us a limited license to store, process, and analyze that data solely to operate the Service for you. We don't use your data to train AI models or share it with third parties for marketing. See our Privacy Policyfor details.

12. Intellectual property

The Consistry name, logo, website design, source code, and AI-generated outputs (when they reflect our prompt design and product logic) are owned by us. You may not copy, distribute, or create derivative products from them without permission. Your trading data remains yours.

13. Service availability

We aim for high uptime but the Service is provided "as-is". We don't guarantee uninterrupted access. We may take the Service offline for maintenance, upgrades, or in case of technical issues with our providers (Supabase, Vercel, Anthropic, Stripe). We'll do our best to give advance notice when planned downtime is required.

14. Disclaimer of warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not warrant that the Service will meet your requirements, be uninterrupted, secure, or error-free, or that AI insights will be accurate or profitable.

15. Limitation of liability

To the maximum extent permitted by law, Consistry and its operators are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service — including, without limitation, trading losses, missed opportunities, lost profits, or data loss. Our total aggregate liability to you for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim, or USD $100, whichever is greater.

16. Indemnification

You agree to defend and indemnify us against any claims, damages, or expenses arising from your misuse of the Service, your violation of these Terms, or your violation of any rights of another party.

17. Termination

You can stop using Consistry anytime by deleting your account from settings. We may suspend or terminate accounts that violate these Terms, abuse the Service, or fail to pay. Upon termination, your access ends and your data is deleted within 30 days (except limited records we're legally required to retain).

18. Changes to these Terms

We may update these Terms periodically. If we make material changes, we'll notify you by email or in the application. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

19. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware.
